VOLUSIA COUNTY, Fla. - Ebony Wilkerson will attempt to gain her freedom at a hearing Monday afternoon.
Wilkerson is the South Carolina woman accused of intentionally driving her minivan into the ocean in Daytona Beach.
She and her three children were inside the van as she drove towards the choppy waters.
Wilkerson was also pregnant at the time.
The dramatic video of beachgoers pulling her children out of the vehicle made national headlines back in March 2014.
Later, in court, Wilkerson tried to explain what was going through her mind that day, “I remember going on the beach, it was, I was under. I felt like a spirit was with me. The Holy Spirit was with me. I remember thinking that my children and me needed to be cleansed.”
A judge ruled Wilkerson incompetent to stand trial and ordered her to stay in a psychiatric facility.
Now, Wilkerson’s attorneys are arguing that she is no longer a threat to herself or others and should be released from the facility.
The children who were in the van at the time are still in state custody.
Her baby, born after her arrest, is in her husband’s care.
