County settles with woman run over on beach

DELAND, Fla. (WOFL FOX 35 ORLANDO) -

The Volusia County Council on Thursday approved a settlement in the amount of $120,000 for a woman who was run over on Daytona Beach by a beach patrol officer.  It happened in June, 2010.

While sunbathing on the beach near Lenox Avenue, 56-year-old Carole Dalton was struck by and pinned beneath a Beach Patrol Vehicle.  She suffered a right tibia fracture, injury to her anterior chest wall and multiple abrasion to her head and chest. The beach patrol officer was cited for careless driving. 

Dalton's medical bills were $64,000.  She was unable to work during her recovery and physical therapy, and says she suffered wage loss over $10,500.  

"This was a case where the county was clearly at fault, this woman was seriously injured, her injuries may continue and this was certainly the fair and proper thing to do to compensate this woman and her family," said Volusia County spokesman Dave Byron.
