Trial begins for Orlando real-estate agent accused of fatally shooting boyfriend
ORLANDO, Fla. (WOFL FOX 35 ORLANDO) -
The trial of an Orlando real-estate agent accused of murdering her boyfriend began on Monday. Caryn Kelley, 48, is charged with manslaughter in the death of Phillip Peatross, 46, back in 2011.
Kelley claims Peatross grabbed a gun she was holding during a struggle, then put it to his head, and the gun went off.
According to investigators, Kelley changed her story a couple times, at one point claiming self defense, while another time claiming it was an accident. Prosecutors hammered on that during opening statements.
Kelly was emotional at times, wiping away tears as the defense laid out their story about what happened that night in College Park. Defense attorney Diana Tennis argued that Kelley thought Peatross was an intruder and that Kelley got out her gun to protect herself.
Neighbors of Kelly were the first prosecution witnesses to take the stand. They describe what they heard the night Peatross was killed.
Kelly faces up to 30 years in prison if convicted. The defense indicated during opening statements that Kelley is likely to take the stand at some point during the trial.
