Philly Officer, Former Cop Accused Of Violating Civil Rights

PHILADELPHIA -

A Philadelphia police officer and a former cop have been arrested by the FBI and are facing charges of deprivation of civil rights under color of law, according to the Philadelphia District Attorney's Office.

According to the indictment, Joseph Harvey, a 39-year-old former officer, overstepped his boundaries as an officer when he made a victim undress completely in front of him and deprived her of the fundamental Constitutional right to be free from unreasonable search and seizure.

Officer Sean Cahill, 34, has also been charged with falsely claiming that Harvey was never alone with the victim . The incident happened on Oct. 9, 2009, according to authorities.

If convicted, Harvey faces a maximum term of one year in prison, a $100,000 fine, and a $100 special assessment; Cahill faces a maximum term of five years in prison, a $250,000 fine, up to three years' supervised release, and a $100 special assessment.

Philadelphia Police Commissioner Charles H. Ramsey has suspended Cahill for 30 days with the intent to dismiss.
