Duggan could testify Monday on NERD fund, EM involvement

A judge granted an emergency motion allowing Duggan to be deposed under oath about his involvement with the emergency manager and the mystery donors involved in the Governor Snyder's controversial, but now defunct, NERD fund. The questioning would take place Monday - one day before the election.

"They're fighting very vigorously to keep this information from becoming public prior to Tuesday's election day," claims labor activist Robert Davis. Davis is suing Duggan, the state and Governor Rick Snyder.

"Mike Duggan was a part of the conspiracy with the governor and governor's team, Richard Baird, to appoint an emergency manager for city of Detroit," Baird says.  

Duggan's legal advisor, Butch Hollowell, denies the allegation and doubts Duggan will be deposed because he believes this lawsuit, like so many others Davis has filed to try and keep the frontrunner off the ballot, will be thrown out.

In fact, just last week Davis asked the Supreme Court to pull Duggan from the ballot for not filing the proper paperwork, and he claimed Detroit's city clerk screwed up the ballots. He called for the ballots to be reprinted, putting this election in jeopardy. But both emergency motions were denied and sent to the court of appeals to be decided at a later date.

"Another frivolous Robert Davis lawsuit, who's really out of control, and this will be dismissed like all the other lawsuits. Mike Duggan had nothing to do whatsoever with the selection of the emergency manager. I also have to point out that Mr. Davis is a supporter of Benny Napoleon; we think that he's behind this," says Hollowell.

Sheriff Napoleon denied to Fox 2 being behind this last ditch effort, but maintains what he has said from the start: Duggan was not only in favor of an emergency manager, he helped the governor every step of the way. He feels the voters have the right to know the truth.
 
"Verify what I've said all along, that Mr. Duggan has been complicit in this process, that he was very much intimately involved with governor and the governor's staff in that he was basically guiding the process," Napoleon tells Fox 2's Taryn Asher.

The state plans to fight this lawsuit.

Sara Wurfel, a spokesperson for Gov. Snyder released a comment saying, "It is really unfortunate that the state has to pay tax payer dollars to counter the endless string of frivolous lawsuits by Mr. Davis."

Wurfel maintains Duggan was never a candidate for the emergency manager position, but he was consulted like many other people in Detroit including Napoleon.

In the meantime the judge ordered Gov. Snyder and the NERD Fund not to destroy or alter any phone records or emails.
